This Privacy Policy (“Privacy Policy”) applies to information Draeger’s Markets, Inc., located at 291 Utah Avenue, South San Francisco, California 94080 (“Draeger’s,” “Company,” “we,” or “us“) collect, use, and share Personal Information and Anonymous Information (each defined below) regarding your use of the Websites and the Services available thereon (each as defined in the Terms of Use located at [https://foodstorm.com/privacy-policy], incorporated herein).

  1. Your ConsentBy using our Website, you consent to the collection and use of information by us as set forth in this Privacy Policy. If we decide to change our Privacy Policy, we will post those changes on this page so that you will always be aware of what information we collect, how we use it, and under what limited circumstances we disclose it. Continued access or use of the Website and Services shall constitute your express acceptance of any modifications to this privacy statement.
  2. Collection of InformationWe collect information you provide directly to us. For example, we collect information when you use our Website, register for our cooking classes, subscribe to our e-newsletter, purchase gift cards or gift baskets, make a reservation at our restaurant, participate in a sweepstakes, contest, promotion, survey, or poll, or otherwise communicate with us through the Website. The types of information we may collect include Personal Information and Anonymous Information. “Personal Information” is information that can be used to identify you (whether alone or in combination), such as your first and last name, email address, zip code/post code, billing address, shipping address, phone number, payment card information, age, and any other information you choose to provide. It also may include sensitive information, such as health and dietary information. “Anonymous Information” is aggregated information (information about Company’s users that it renders in such a way that it no longer identifies or references an individual user) and other pseudonimized information which cannot be used to identify you.Purchases of products or services made using the Services (for example, gift cards or deli or bakery orders) must be made by credit or debit card. All credit and debit card information is provided directly to our third-party payment processor. Company does not directly access, handle, or store your credit or debit card information, but may store the first 2 digits and last 4 digits of the credit card used to verify your order upon pick-up and otherwise trace the order in accordance with this Privacy Policy. To make a purchase via the Services, you will need to submit your name and your credit or debit card type, number, expiration date, security code, and billing address. Payment by credit or debit card is subject to the approval of the card issuer. We will not be liable in any way if a card issuer refuses to accept a credit or debit card for any reason. We will maintain a record of the purchases that you make via the Services.If you submit a job application through the Website, we will collect your resume and all other materials and information that you provide in the course of submitting that application. That information will be submitted to the provider of our online employee portal, Ceridian Dayforce, for evaluation purposes. We encourage you to review Ceridian Dayforce’s Privacy Policy here. We may use your job application to evaluate your qualifications and to otherwise consider or respond to your application for employment. Your submission of a job application does not in any way require Company to review that application or consider you for employment.

    If you enroll in the Loyalty Program, you may be asked to provide certain Personal Information in order to sign up, including, without limitation, your full name, address, e-mail address, credit card information, and school or non-profit selection. The Loyalty Program is administered through Escrip and is subject to Escrip’s Terms of Use and Privacy Policy available here and here, respectively. We encourage you to review each policy carefully before signing up for the Loyalty Program.

    Occasionally our manufacturers or we may deliver and administer coupons to you by and through our coupon delivery Service Provider (as defined below), and may collect certain Personal Information and Anonymous Information from you when you redeem the coupons, such as the credit card used with the coupon, transaction amount, purchase data, and store location redeemed. Such Service Providers may need such information in order to perform the services.

    If you agree via the Services or otherwise sign up to receive communications or promotions from us, you will need to submit your full name, address, and/or email address. We will use this information to send you marketing messages and other Company promotional materials. If you do not wish to receive such messages and materials, you may notify Company of your preference by following the instructions included in each communication (e.g., the unsubscribe instructions contained in the applicable email).

    Cookie Policy, Tracking, and Interest-Based Advertising
    The Services and Website may automatically collect data pertaining to you and the equipment, software, and communication methods you use to access the Internet and the Services. This information includes Internet protocol (“IP”) addresses assigned to the computer from where you access the Internet, your approximate geographic location, your mobile device ID numbers and identifiers, pages visited on the Website, website pages visited before and after visiting our Website, type of web browser used, type of operating system, the domain name of your Internet service provider (ISP), the length of time you spend on the Services, date and time stamps, and clickstream data. Company may use this information to administer the Services, to generate statistical information, to monitor and analyze Service traffic and usage patterns, to monitor and prevent fraud, to investigate complaints and violations of our policies, and to improve Website and Services content and the products, services, materials, and other content that we describe or make available through the Website or the Services. This may include Personal Information, and we may combine this information with Personal Information, Anonymous Information, and information obtained from third parties for security reasons. The suppliers that we use to provide the Services may collect information about your use of the Services and your visits to the Website and other websites.

    The Website automatically uses cookies to track website use and to facilitate and enhance the user experience on the Website. Cookies are small pieces of data that are stored by a user’s web browser on the hard drive of a user’s computer.     The Services may allow you to connect and share information with various social media platforms, for example, Facebook, Instagram, Twitter, Pinterest, and YouTube. These features may require us to implement cookies, plug-ins, and application protocol interfaces (APIs) provided by those social media platforms to facilitate those communications and features. We may share information that you provide us or that we may collect about your use of the Services with those platforms and that information will be subject to their privacy policies. As a result, we cannot be responsible for any use of your information or content by a third-party platform, which you use at your own risk. The Services may also use the advertising services and networks offered by those social media platforms to deliver advertising content. Use of these services requires social media platforms to implement cookies or pixel tags to deliver ads to you while you are logged into the platform. Company is active on social media, including Facebook, Instagram, and YouTube. You have the opportunity to comment on those social media platforms regarding Company and the products and services we offer. Company reserves the rights to post on its websites and social media pages any comments or content that you post on our social media pages.

    We engage third parties, such as Google’s DoubleClick, Facebook Pixel, and others, to serve advertisements, retarget advertisements, prepare or participate in interest-based advertising, and build lookalike audiences on our behalf across the Internet, and to provide analytics about the use of our Website. In addition, we may participate in online advertising networks and exchanges that display relevant advertisements to our Website visitors based on their interests as reflected in their browsing of the Website and certain third party sites participating in the same networks and exchanges. These entities may use cookies, web beacons, pixels, embedded scripts, and other technologies to automatically collect information about your use of the Website, such as your IP address, web browser, pages viewed, time spent on pages, links clicked and conversion information. This information may be used by us and others to, among other things, analyze and track data, determine the popularity of certain content, deliver advertising and content targeted to your interests on the Website and other websites and better understand your online activity.   4. Sharing of InformationOur agents, vendors, consultants and other service providers (each, a “Service Provider”) have access to Personal Information to carry out work on our behalf. These third party Service Providers and agents are prohibited from using your Personal Information for any purpose other than to provide their services, and we limit the Personal Information shared with such Service Provider to that which is necessary to fulfill the applicable Service Provider’s services.In addition, we may share information about you as follows:
    • To the maximum extent permitted by applicable law, in response to i) subpoenas or other legal process or if in our good faith opinion such disclosure is required or permitted by law; (ii) at the request of governmental authorities conducting an investigation;

    In our sole discretion, we may also share aggregated or de-identified information that cannot reasonably be used to identify you with third parties or affiliates.

  5. Online CateringWe partner with a third-party software provider, CaterXpress USA Inc. dba FoodStorm (“FoodStorm”), to facilitate customer catering orders. When you place an order on our Website, you will be taken to FoodStorm’s platform. FoodStorm will collect certain customer information and will process your online payments. FoodStorm shares limited information with Draeger’s so that we can fulfil your order. Please review FoodStorm’s Privacy Policy and Terms of Use.

Third Party WebsitesWe make no representations and accept no responsibility or liability regarding the policies or business practices of Linked Websites and encourage you to familiarize yourself with their privacy policies before providing them with your Personal Information. Our Privacy Policy does not apply to these Linked Websites. You should read the privacy policy of each Linked Website as these Linked Websites may use their own cookies, web beacons and other technology to independently collect information about you. In addition, these Linked Websites may solicit Personal Information from you.

Analytics, Advertising, Online Tracking and Your ChoicesSubject to the terms herein, you may review and edit certain Personal Information Company collects about you at any time by contacting Company at the addresses below. If your information has been shared with a third party, as described elsewhere in this Privacy Policy, then that third party has received its own copy of your data. If you have been contacted by one of these third parties and wish to correct or delete your information, please contact them directly.You may opt out of certain collection practices, including, without limitation, in accordance with the following:

    • Note that your browser settings may allow you to automatically transmit a “Do Not Track” signal to sites and online services you visit. There is no consensus among industry participants as to what “Do Not Track” means in this context. Like many websites and online services, Company currently does not alter its practices when Company receives a “Do Not Track” signal from a visitor’s browser.
